MLCC Imposes Civil Penalty For Day Campers

The Moses Lake City Council approves a civil penalty for those caught camping in open spaces during the daytime. A measure passed earlier this year didn’t include any enforcement language due to a Ninth U.S. Circuit Court of Appeals ruling that cities cannot prosecute people for sleeping in public places if they have nowhere else to go because it amounts to cruel and unusual punishment. The first fine is $20 and $40 for any other within a 12 month period.
